1. Identity of the trader

2. Applicability
2.1. These terms and conditions apply to every offer from Grill Master Gloves and to every agreement concluded between Grill Master Gloves and the consumer.

2.2. Before the (distance) contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, Grill Master Gloves will indicate how the consumer can view the terms and conditions, which are in any event published on the website of Grill Master Gloves, so that the consumer can easily store the terms and conditions on a durable medium.

2.3. In exceptional situations, these terms and conditions may be deviated from if this has been explicitly agreed in writing with Grill Master Gloves.

2.4. These terms and conditions also apply to additional, amended and follow-up purchases with the consumer.

3. The offer
3.1. If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.

3.2. The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable the consumer to properly assess the offer. Grill Master Gloves uses images that truthfully represent the products and/or services offered. Grill Master Gloves cannot guarantee that the colors in the images exactly match the actual colors of the product. Obvious mistakes or obvious errors in the offer do not bind Grill Master Gloves.

3.3. Each offer contains such information that it is clear to the consumer what rights and obligations are attached to acceptance of the offer.

3.4. Grill Master Gloves has the right to refuse an agreement with a potential buyer for a reason that Grill Master Gloves considers well-founded.

3.5. Delivery times and periods stated in the offer of Grill Master Gloves are indicative and, if exceeded, do not entitle the consumer to dissolution or compensation, unless expressly agreed otherwise.

3.6. If and insofar as a special offer applies, it does not automatically apply to follow-up orders or repeat orders. Special offers are only valid insofar as they are provided to the consumer.

4. Formation of the agreement
4.1. The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set out therein.

4.2. If the consumer has accepted the offer electronically, the trader will confirm receipt of the acceptance of the offer electronically without delay. As long as receipt of the acceptance has not been confirmed by Grill Master Gloves, the consumer may dissolve the agreement.

4.3. If the agreement is concluded electronically, Grill Master Gloves will take appropriate technical and organizational measures to secure the electronic transfer of data and Grill Master Gloves will ensure a secure online environment. If the consumer can pay electronically, Grill Master Gloves will observe appropriate security measures for this purpose.

4.4. Grill Master Gloves is not bound by an offer if the consumer could reasonably have expected, or should have understood, that the offer contains an obvious mistake or clerical error. The consumer cannot derive any rights from such a mistake or clerical error.

5. Right of withdrawal and cooling-off period
5.1. The consumer has the right to exercise their right of withdrawal with respect to non-custom products within the statutory period of 30 days.

5.2. The cooling-off period referred to in paragraph 1 begins on the day the consumer has received the product.

5.3. If withdrawal applies, the consumer shall handle the products and packaging with care. The consumer shall only unpack or use the product to the extent necessary to establish the nature, characteristics and functioning of the product.

5.4. The costs of returning the product are borne by the consumer.

5.5. If the consumer exercises their right of withdrawal, they shall notify Grill Master Gloves of this within the cooling-off period by sending an email to: info@grillmastergloves.com. Grill Master Gloves will inform the consumer about the further return steps.

5.6. The consumer shall return the product with all accessories supplied, if reasonably possible in its original condition and packaging, in accordance with the reasonable and clear instructions provided by Grill Master Gloves.

5.7. The consumer is only liable for any decrease in value of the product resulting from handling the product in a way that goes beyond what is permitted in paragraph 1.

6. Performance of the agreement
6.1. Grill Master Gloves will perform the agreement to the best of its knowledge and ability.

6.2. The consumer shall ensure that all information which Grill Master Gloves indicates is necessary, or which the consumer should reasonably understand to be necessary, for the performance of the agreement is provided to Grill Master Gloves in good time. If the information required for the performance of the agreement has not been provided to Grill Master Gloves in good time, Grill Master Gloves has the right to suspend performance of the agreement.

6.3. Grill Master Gloves is not liable for damage of any kind arising because Grill Master Gloves relied on incorrect and/or incomplete information provided by the consumer, unless this incorrectness or incompleteness was known to Grill Master Gloves.

6.4. The consumer indemnifies Grill Master Gloves against any claims by third parties who suffer damage in connection with the performance of the agreement and which are attributable to the consumer.

7. Conformity and warranty
7.1. Grill Master Gloves guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability, and the statutory provisions and/or government regulations in force on the date the agreement was concluded.

7.2. Grill Master Gloves does not guarantee that the product is suitable for anything other than normal use.

7.3. Any defects or incorrectly delivered products must be reported in writing to Grill Master Gloves within 3 days of delivery. Products must be returned in their original packaging and in new condition.

 

8. Payment
8.1. Unless otherwise provided in the agreement or additional terms, the amount due must be paid immediately after the agreement is concluded.

8.2. The consumer has the obligation to report any inaccuracies in payment details provided or stated to Grill Master Gloves without delay.

8.3. If the consumer does not meet their payment obligation on time, they will be granted a period of 14 days to meet the payment obligation. If payment is not made within this 14-day period, statutory interest will be charged on the amount still owed and Grill Master Gloves is entitled to charge the extrajudicial collection costs it has incurred.

8.4. Payments are processed securely via an external payment provider in Shopify.

9. Delivery
9.1. Grill Master Gloves exercises the greatest possible care when receiving and executing orders for products and when assessing requests for the provision of services.

9.2. The place of delivery is the address that the consumer has made known to the trader.

9.3. If delivery is delayed, or if an order cannot be fulfilled or can only be partially fulfilled, the consumer will be notified of this no later than 30 days after placing the order. In that case, the consumer has the right to dissolve the agreement free of charge.

9.4. After dissolution in accordance with the previous paragraph, Grill Master Gloves will refund the amount paid by the consumer without delay.

9.5. The risk of damage to and/or loss of products rests with Grill Master Gloves until the moment of delivery to the consumer or to a representative designated in advance and made known to Grill Master Gloves, unless expressly agreed otherwise.

10. Retention of title
10.1 Ownership of the delivered products only passes to the consumer once they have paid the full amount due to the trader. The risk of the products passes to the consumer at the moment of delivery.

11. Complaints procedure
11.1. Grill Master Gloves has a sufficiently publicized complaints procedure and handles complaints in accordance with this complaints procedure.

11.2. Complaints about the performance of the agreement must, within a reasonable time after the consumer has discovered the defects, be described fully, clearly and in writing and submitted to Grill Master Gloves via info@grillmastergloves.com.

11.3. Complaints submitted to Grill Master Gloves will be answered within a period of 14 days from the date of receipt. If a complaint foreseeably requires a longer processing time, Grill Master Gloves will reply within a period of 14 days with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed answer.

12. Additional provisions
12.1. The agreement between Grill Master Gloves and the consumer to which these terms and conditions relate is governed exclusively by Dutch law.

12.2. The trader is entitled to amend these terms and conditions. Amendments to these terms only take effect after they have been published.
